and the automated manipulation of services that can deceive voters.

The Commission also requests information and internal documents on risk assessments

and mitigation measures

related to the impact of generative AI on electoral processes,

dissemination of illegal content, protection of fundamental rights, gender-based violence, protection of minors, mental well-being, protection of personal data, consumer protection and intellectual property.

The questions concern both the dissemination and creation of generative artificial intelligence content.

the EU has sent a request for information asking for more details on how their service complies with the ban on profiling-based advertisements using particular categories of personal data.

LinkedIn is also required to provide information on how it ensures that all necessary transparency requirements for advertisements are provided to its users.

Interested companies must provide the Commission with the requested information by April 5, 2024

for election protection matters and by April 26, 2024 for remaining matters.

A request for information is an investigative action which does not prejudge any further steps the Commission may or may not decide to take.

Based on the evaluation of the responses, the Commission will evaluate the next steps


Under Article 74(2) of the DSA, the Commission

may impose sanctions

for incorrect, incomplete or misleading information in response to a request for information.

In case of failure to respond from the VLOPs and VLOSEs, the Commission may

decide to request the information by decision


In this case, failure to respond within the deadline could result in the imposition of late penalties.

Generative AI is also one of the risks identified by the Commission in its draft guidance on the integrity of electoral processes.

Their aim is to provide VLOPs and VLOSEs with best practices and examples of potential election-related risk mitigation measures, including specific measures related to generative artificial intelligence.
