The Abu Dhabi Family Court and Civil and Administrative Cases ordered a young man to pay the owner of a garage 10,<> dirhams, as compensation for the material and moral damages resulting from the defendant's damage to the entrance door and another door of a garage owned by the plaintiff.

In the details, the owner of a garage filed a lawsuit against a young man, demanding that he pay him 55,5000 dirhams for the value of damages and breakage and compensation for the material and moral damages suffered by him, as well as obliging him to fees and expenses and for attorney's fees, noting that the defendant damaged the entrance door and another door on the first floor of the plaintiff's garage, and he was criminally convicted of damage and punished with a fine of <> dirhams.

For its part, the court clarified in the reasons for its judgment that the judgment issued in criminal matters shall have authority in the civil lawsuit before the civil courts, as long as it has been properly detailed in the occurrence of the act constituting the common basis between the criminal and civil lawsuits, and in the legal description of this act and its attribution to its perpetrator, noting that it is clear in the papers that the mistake committed by the defendant, which is to destroy the entrance door and one of the doors on the first floor of the garage belonging to the plaintiff, is the same error on which he based The plaintiff in filing the present lawsuit.

Regarding the plaintiff's request for 5000 dirhams for the value of destroying the doors, and 50,<> dirhams for material and moral compensation, the court pointed out that according to the decision of the Civil Transactions Law that every damage to others obliges its perpetrator, even if not distinguished, to guarantee the damage, and the plaintiff suffered as a result of damaging the doors material damage represented in damaging those doors and going to the police station to open a report, transportation and follow up the criminal case until a final judgment is issued, as well as the state of terror, fear, sadness and sorrow during that incident

After that, the court ordered the defendant to pay the plaintiff 10,<> dirhams as compensation for the material and moral damages suffered by him, and to oblige him to pay fees and expenses.
