A man discovers selling his car without his knowledge

A man (Arab) went to register a car «Land Cruiser», bought four days ago, and was surprised by the appearance of its original owner (Gulf), with the paper of possession of the car, so he had to hand over the car, and then filed a lawsuit demanding the seller to pay him 33 thousand dirhams, paid to him as part of the value of the car, and a court ruled to stop the lawsuit until the decision on «discrimination».

In detail, the plaintiff stated that he bought from the defendant a car «Land Cruiser» under a contract worth 43 thousand dirhams, and it was agreed to pay the amount in installments, where he handed him 8000 immediately after the agreement, and 15 thousand dirhams in his office, and 10 thousand dirhams when they went to register the car, but he was surprised after four days in the presence of a person (Gulf) with the paper of possession of the car, and told him that he was the owner of the car, so he had to hand it over to him, and by reviewing the defendant denied the agreement with him to sell the car, pointing out that the agreement It was done in the defendant's office, and there were surveillance cameras that recorded the entire events, and there were voice messages between them.

The defendant pointed to the lack of jurisdiction of the court locally to hear the lawsuit, considering that he lives in Abu Dhabi, and that the agreement was made in Sharjah, and asked to reject the lawsuit for lack of validity and proof, as he did not agree with the plaintiff to sell the car, but the latter took it from scrap in the Emirate of Ras Al Khaimah, without the knowledge of its owner, and asked him to intervene to prevent its owner from opening a report against him, and signed the receipt of an amount of 15 thousand dirhams handed over to the owner of the vehicle, and the latter waived the report of the theft, and denied receiving it 33,<> dirhams from the plaintiff, and that his signature on the sales contract that includes his ID number is different from his identity.

The plaintiff stated that the incident took place in the Emirate of Ras Al Khaimah, and the car was in the possession of the defendant when it was received from the garage, in the presence of another person.

The real owner of the vehicle stated that he does not know the plaintiff, and that he opened a report against him in the Mamoura center in order to steal his car, and the sale contract is incorrect, and that he waived the report after receiving 15,<> dirhams from the plaintiff.

The judgment of the Ras Al Khaimah Civil Court stated that the defendant requested that the case be stayed until the cassation lawsuit was decided, and that the appeal judgment had been challenged by cassation.

It ruled that the case should be suspended pending a decision on "discrimination".
