After the Constitutional Court's decision yesterday (23rd) that the bill to drastically reduce the investigative powers of prosecutors, the so-called "scrutiny" bill, passed by the National Assembly led by the MDP last year, is not invalid, the MDP has decided to take further measures in various ways.

'Han Dong-hoon Enforcement Decree' Judiciary Committee

As a result of the SBS interview, the MDP agreed to introduce Article 98(2)(3) of the National Assembly Act, which requires the Standing Committee to consider whether the government's enforcement decree meets the purpose of the bill, East Sea put it on the agenda of the Judiciary Committee.

Democrats are arguing that Attorney General Han Dong-hoon expanded the scope of prosecutorial investigations by creating an enforcement decree that runs counter to the prosecutor's bill, and the Judiciary Committee will point out that the Justice Department's enforcement decree runs counter to the law.

However, the current chairman of the Judiciary Committee is Kim Do-eup, a member of the People's Power, so it is unclear whether it can be put on the agenda according to the will of the MDP.

In response, a member of the Democratic Judiciary Committee said, "Democratic lawmakers and members of the Judiciary Committee have already completed one review," adding, "Since the ruling party chairs the Judiciary Committee, there are doubts about its effectiveness, but we plan to request it next week."

Another Democratic Judiciary Committee member also said, "If the ruling party's Judiciary Committee chairman does not even bring up the agenda in such a decision, he will have to be cursed a lot."


Convocation of the Special Committee, Consideration of the Authority Dispute Edition Card

The MDP is also reportedly considering filing a dispute of authority with the Constitutional Court on the grounds that the Justice Ministry's enforcement decree on the prosecutor's investigative powers infringes on the legislative powers of the National Assembly.

However, if the claimant is an opposition member of parliament, there may be eligibility issues, so it is understood that the actual claim is cautious.

The MDP also decided to actively demand the convening of the National Assembly's Special Committee on Criminal Justice System Reform (Special Committee on Criminal Justice Investigation) to discuss the establishment of the Serious Crime Investigation Agency.

Chung Sung-ho, chairman of the Special Committee on Private Affairs, told SBS that "it is unclear whether the ruling party will comply," but that "we will discuss convening a meeting through the staff."

The Constitutional Court, in a 5-4 opinion yesterday, ruled that Judiciary Committee Chairman Park Kwang-on, a member of the Democratic Party, passed the "scrutiny" bill in April last year as a violation of the lawmakers' right to deliberate and vote, but that the bill's approval by the Judiciary Committee and the plenary session was not invalid.

While pointing out the procedural problems with the passage of the Inspection and Inspection Act, he acknowledged the validity of the bill.

It also rejected a 4-6 vote against Justice Minister Han Dong-hoon and six prosecutors alleging that the "prosecutor's office" legislation violated prosecutorial powers.

With Representative Lee Jae-myung and other members of Congress under investigation by the prosecutor's office, the Democratic Party's offensive against the prosecutor's office, which won the verdict based on the constitutional judgment, is likely to intensify.
