The European Policies Committee in the Senate voted in favor of the majority resolution, presented by FDI, on the proposal for an EU regulation on the recognition of children also from same-sex parents, in view of a European filiation certificate. The fourth commission, chaired by Giulio Terzi di Sant'Agata, precluded the resolutions presented by the Pd, M5S and Terzo Polo.
The resolution adopted is contrary to the EU indication.
The resolution adopted in the fourth committee states that "it is considered to deliver a reasoned opinion pursuant to Article 6 of Protocol No 2 annexed to the European Treaties, since certain provisions contained in the proposal, and in particular the obligation to recognise (and subsequently record) a judicial decision or authentic instrument, issued by another Member State, attesting to the filiation, and the obligation to recognise the European filiation certificate, do not comply with the principles of subsidiarity and proportionality".
"The 'European' proposal does not respect the principles of subsidiarity and proportionality in so far as it allows the grounds of public policy to be invoked only on a case-by-case basis and does not provide for it to be invoked to refuse recognition of the European parenthood certificate". "This resolution is also to be understood as an act of address to the government, pursuant to Article 7 of Law No. 234 of 2012", concludes the text.
The majority resolution passed with 11 votes in favor and 7 against. Compact on the no all the oppositions.
