While the report of the engineering expert in the field of information technology delegated by the court showed that the plaintiff bought from the defendant a communication account «Snapchat» for 40 thousand dirhams, and the account does not exist on the social media platform «Snapchat», so the expert could not preview the account or determine the date of its creation and track its status and was not technically able to know the reasons for the closure, indicating that the owner of the original account is a woman (Arab) and the defendant was playing the role of an intermediary in selling the account for a commission, and the plaintiff used the account For a period of about a month, then sold it to another person for 50,<> dirhams, and the new buyer used the account for three days and then could not access the account, and could not determine whether the account was closed or withdrawn from the management of «Snapchat».

The report indicated that after examining the expertise of the plaintiff's mobile phone and examining the messages exchanged between the two parties regarding the terms of the contract and the commitment of each party via the social networking application «WhatsApp», the defendant sent a message to the plaintiff explaining that he communicated with the original owner of the account, and that the original owner told him that Snapchat withdrew the account and addressed the management of «Snapchat» to solve the problem and no response was received.

The court stated in the reasoning of the judgment that the technical expert confirmed in his report that it was not possible to know the technical reasons that led to the closure of the account, indicating that the plaintiff used the account for a period of approximately one month and disposed of it, which the court concludes that the plaintiff received the account from the defendant free of defects and used it for a not simple period, and it was not proven from the papers that the defendant had a role in closing the account, and therefore his claim to rescind the contract and recover the price is unsubstantiated. True, and ruled to dismiss the case as stated in the reasons.
