The Provincial Court of Madrid has ordered the revocation of the file of the so-called ITV case and the reopening of this judicial process, where the current mayoress of Móstoles, Noelia Posse (PSOE),

and

seven

councilors of her

local Executive are listed as being investigated for the alleged fraudulent remission of a debt to the company ITV Móstoles SL

The Court of Instruction number 1 of Móstoles agreed to the provisional dismissal of this case, understanding that "at no time has there been a will on the part of the Local Government Board to cause damage to the public coffers", but now the Provincial Court has reversed that decision.

In an order advanced by the newspaper

El País

and to which EFE has had access, the Court upholds the appeal filed by two mayors of Más Madrid, Gabriel Ortega and Susana Millán.

"We must revoke and we revoke the order issued by the Investigating Court number 1 of Móstoles, in the sense of annulling that dismissal and ordering the Investigating Court to agree to the transformation of the case into Abbreviated Procedure," the order insists.

In addition to the current mayoress, the case investigates the first deputy mayor,

David Muñoz

;

the Councilor for Employment and New Technologies,

Rebeca Prieto

;

that of Security, Coexistence, Culture and Ecological Transition,

Alejandro Martín

;

and that of the Presidency and Urban Development,

María Luisa Ruiz

, all of them from the PSOE.

Also appearing as investigated are the current Socialist Councilor for Equality,

Dolores Triviño

;

the previous person in charge of said area,

Beatriz Benavides

, also from the PSOE although now retired and outside the Corporation;

and the mayor of Education and Youth,

Natividad Gómez

, the latter of Podemos.

All of them, together with the mayoress and the exedil of the Treasury and now Human Resources,

Aitor Perlines

(PSOE), who were also called to testify in the same case, were part of the local Government Board that approved the cancellation of a debt to the company ITV Móstoles SL

The complaint that gave rise to the investigation was filed in February 2021 by the two mayors of Más Madrid in Móstoles, Susana García and Gabriel Ortega, understanding that the City Council "forgave the collection of fees" derived from the use of public land so that the aforementioned company could develop its activity in the locality, attending "to the interest of the private company".

However, the head of the Investigating Court number 1 of Móstoles insisted in her order of dismissal, now revoked, that it had been "proven, despite what the complainants say, that the agreement reached was favorable for the public coffers."

In this sense, it reiterated that the agreement reached "was the lesser evil", since "if the company ITV Móstoles SL had been declared insolvent, the City Council of Móstoles would have had serious difficulties in asserting its credit right against other privileged credits"
