The Abu Dhabi Family Court and Civil and Administrative Cases ordered a retired employee to vacate a villa he had received to reside in during his work in one of the entities, and refused to vacate it after his retirement in 2016.

In the details, a government entity filed a lawsuit against a retired employee, in which it demanded that he be obliged to vacate a villa and hand it over to it free of concerns and people, and oblige him to bring a clearance of water, electricity and communications, in addition to obliging him to fees and expenses, noting that it owns the villa in question, and it was allocated to the defendant during his period of work, until the employment relationship ended in 2016, by referring him to retirement, and he was given a period of more than five years, with a warning, but he refrained from handing over the property, and she submitted a bond for her lawsuit. A copy of the land plan and the end-of-service certificate issued by the plaintiff, showing the termination of the defendant's services due to retirement, in addition to a letter of housing allocation.

For its part, the court clarified in the reasons for its ruling, that it is established in the Civil Transactions Law, that the right of ownership is the authority of the owner to dispose of his property in an absolute manner in kind, benefit and exploitation, and the owner of the thing alone can benefit from the owned property, its yield, fruits and products, and dispose of all permissible actions Shariah, pointing out that the lawsuit for expulsion for usurpation is to protect the right to use the thing and exploit it by recovering it from the unjustly seized, whether the initial laying of his hand without a basis or for a legal reason Then the reason was gone, and he continued to lay his hand on it.

The court pointed out that it is proven that the plaintiff had allocated to the defendant the villa in question, and he was referred to retirement and refused to vacate the residence, despite the termination of service, and the court found that the defendant was declared and did not attend, and did not pay the lawsuit with a payment, and did not receive from its papers, which must be eliminated by vacating the eye, and the court ruled to evict the defendant from the villa and hand it over to the plaintiff free of concerns and persons, and oblige him to submit a clearance of water, electricity and communications, and oblige him to fees and expenses.

The employer gave him five years with a warning, but he refrained from handing over the property.
