A young man uses his friend's car and commits violations of 6000 dirhams

Al Ain Court of First Instance ruled to transfer traffic violations worth AED 6000,<> on a vehicle from the traffic file of its owner to the traffic number of a friend, for the latter taking the vehicle without the knowledge or consent of its owner, and committing several violations that include a violation that requires imprisonment.

In the details, a young man filed a lawsuit against a friend of his requesting that the violations he committed with his car be transferred to the defendant's traffic code, noting that he took the vehicle owned by him without his knowledge or consent, and committed the violations with it.

He said that when he asked the defendant to return the vehicle, he refused to do so, and continued to possess it until he was arrested on charges of abuse, and was convicted under a criminal judgment, pointing out that the defendant committed traffic violations on the vehicle during this period in the amount of 6000,<> dirhams, and one of the violations includes a prison sentence, which prompted him to file the lawsuit.

The plaintiff submitted a copy of the vehicle license, a copy of the fines and a copy of the criminal judgment, while the defendant did not attend the hearings of the lawsuit despite his announcement.

For its part, the court stated in its reasoning that it is established from reading the papers that the vehicle subject of the lawsuit belongs to the plaintiff, and was in the possession of the defendant on the date of committing the incident subject of the criminal case. The violations required to be transferred to his traffic code were on the same date, and therefore he is liable for the violations on the vehicle while in possession of it, especially since the defendant did not appear, either in person or by his agent, to pay the lawsuit with any defense or defense that affects it.

The court ordered the defendant to transfer the traffic violations committed on the vehicle subject of the lawsuit from the plaintiff's name to his traffic code.
