The story of 'that day' in history that we should not forget is told by 'Jang Trio' Jang Hyun-sung, Jang Sung-kyu and Jang Do-yeon on SBS' 'The Story of the Day with the Tail on the Tail' (hereinafter referred to as 'Kokomoo'). For those who missed the main broadcast, or for those who have watched the broadcast but want to reflect on it again, SBS Entertainment News will summarize it in one room.
The story of "that day" that I would like to tell "you" this time is the episode of "Nakdong River Murder - The Miracle of the Nakdong River" that was broadcast on the 25th. The cast included actor Kim Jung-tae, singer Lee Chae-yeon, and model Lee Hyun-yi. (The review will be conducted in half-horse mode, in keeping with the nature of "Kokomu".)

It was the evening of November 1991, 11, at a family home in Myeongji-dong, Busan. 8-year-old Jang Dong-ik came home from work. When I saw my daughter's face smiling brightly at her dad, my tiredness seemed to melt away. Just as I was about to eat my wife's elaborate dinner, suddenly someone from outside slammed the front door and said, "Are you Mr. Jang Dong-ik?" Dong Yik went outside to see who had come.
However, my husband, who seemed to be coming soon, hasn't returned even after a while. She opened the front door. But there is no husband, no man who came to visit him, and there is only darkness. Back in the days when there were no cell phones. I don't have a way to contact my husband.
Mr. Dong-ik's wife stomped all night with her sleeping child on her back, and the next morning she went to visit her husband's friend's house who lived nearby. However, my husband's friend's wife said, "Dong-ik? My husband didn't come home yesterday." Suspicious men came late last night, showed me the handcuffs, and took my husband away. As it turned out, they were both taken to the police station.
Dong Ik's wife and mother rushed straight to the police station. When I found out what happened, I found out that Dong Ik was impersonating a police officer with his friend. People practicing driving without a license near the Nakdong River were told that they were the police and they were robbed of money. Mr. Dong Yik assured his family that the police had misunderstood, that it was no big deal, that he would be released soon, and that he should not worry and go home. Believing it, the family went home.

A few days later, while we were watching TV at Dong Ik's parents' house, news broke that two criminals had been arrested for raping and murdering women in a brutal manner on the banks of the Nakdong River. The perpetrator of a terrible incident that remained unsolved for two years has been caught. However, while watching TV, Dong-ik's mother was surprised and surprised. My son, Dong-ik, was on TV in handcuffs. He was arrested for impersonating a police officer, and even that was no big deal, but he was a rape killer. What the hell is going on here? To find out the truth, we have to
go back two years to the time of the murder
on the Nakdong River, which took place in the early morning of January 2, 2. Detectives searched the area around the Nakdong River for something and found a black vehicle. There were no people in the car, and the car door was left wide open on the riverside road.

White woman slippers that fell on the side of the vehicle. Detectives found the owner of the slippers. There were blood stains around the vehicle, and the blood trails went all the way down to the Nakdong River. The detectives walked cautiously down the trail toward the river. About 30 meters from the car, at the beginning of the reed forest, I noticed something. It was a human foot. As I got closer, I looked through the reeds and saw a woman lying dead, covered in blood. He's the owner of the white slippers the detectives were looking for.

His name is Park Hyun-joo (pseudonym), and he is 31 years old. It looked terrible when it was discovered. Her arms are up, and her top is rolled upwards. And the face, it's hard to make out the shape. The autopsy revealed that the cause of death was a comminuted fracture of the skull depression. Something hit me in the head badly.

There are eyewitnesses to this incident. There was a passenger in the car. This is Hyun Joo and his colleague Kim Young-jun (pseudonym). But Kim is in the hospital. I had three weeks of injuries to my face and all over my body.

According to survivor Kim, Kim was dating Hyun Joo. I was listening to a song when someone came up to my car and said, "It's a police officer. There will be a brief inspection." When the police told him, Kim rolled down the window without question, but the gunman suddenly threatened him with a pistol, opened the car door, and started beating him hard. The men threatened the two men and drove them towards the Nakdong River. When they arrived at the riverside, they tied Kim's hands with tape and dragged him toward the river. At that moment, the tape that bound his hands came loose, and he managed to get out after arguing with the goon. Kim then called the police, but the perpetrators had already killed Hyun Joo and fled.

Kim said of the perpetrators he witnessed, "One of them is a little taller than me. He's got a good physique. The other one was a little shorter."
There was a woman's handkerchief found near the crime scene. There were male bodily fluids and blood stains on it. Unfortunately, this was before the introduction of DNA detection technology. That's why I can only check my blood type. The blood type detected on the handkerchief was 'AB'.
Detectives have been investigating nearby bullies and ex-convicts, but it is not easy to identify suspects. Two years passed, and one day a report came to the Busan Saha Police Station. Near the Nakdong River, there were reports of two scammers posing as police officers.
The word impersonation of a police officer flashed through the detective's mind with the Nakdong River murder case that took place two years ago. The detective's hunch kicked in, and the arrest was made by Jang Dong-ik and his friend Choi In-cheol. The two coincidentally resemble the criminals' impressions that survivor Kim said.

The police called Mr. Kim to see Mr. Dong-ik and Mr. In-cheol, and when he saw the two of them, Mr. Kim said:
"The moment I first saw the main culprit, the tall Choi In-cheol, yesterday in the Criminal Division chief's office, the voice was that voice, and it was clear that he was the big criminal at the time, and even now, two years after the incident, I remember it clearly because I was a commercial taxi driver and tried to find the face of a young man when he got on. Jang Dong-ik, who is short in stature, cannot confidently say that he is that person, but his speech and physique must have been the culprit at that time."
Kim clearly remembered the criminal's face, build, and voice, so he could recognize the two as the culprits. And the conclusive evidence that was at the scene, the blood type that came out of the handkerchief was AB, right? In-cheol's blood type was also AB. Immediately, the police began to pursue them.

"You bring him into the office, you sit him down, and he says, 'Why did you kill him?' You're talking right out of your own mouth. He knew at first that he wasn't being caught for blackmail, he was being caught for murder. After the incident, after killing this woman, I dreamed that a white-haired ghost appeared and wrapped itself around my neck."

in charge, Dong Ik and In-cheol, confessed. We did a field examination, and the place and manner of the crime were accurately reenacted. And a month before the murder, there had been similar robberies, and it turned out that the perpetrators of those cases were Dong Ik and In-cheol. Eventually, the two men were sent to the prosecutor's office. On charges of robbery-murder, robbery, robbery, and rape.

Mr. Dong-ik's wife is so confused that she can't believe that her husband would do such a terrible thing. She remembered that day two years ago, January 2, 1990. Her husband, Dong Ik, went to work on January 1, the day before the incident, and immediately returned home after work to spend time with his family and fell asleep with his wife. Then, on the morning of the 4th, I went to work. If Dong Ik is the culprit, he committed the crime by sneaking out of the house around 1 a.m., when everyone was asleep.
Kim, a survivor, said she fled the scene around 3:4 a.m. on the day of the incident. Then the victim was killed, and it was after that. According to the police investigation, the two men struck the woman with a knife and struck her with a stone the size of a fist. It's about 2 kilometers from the scene of the incident to Dong Ik's house. If a strong adult male runs non-stop, it takes about 4~30 minutes. So Dong Yik murdered the woman after 8:40 a.m., abandoned her body, and then returned home and went to work until 50 a.m. Is this possible? It's not easy, but it's not completely impossible.
Dong Ik's mother is also distraught. I went to the detention center and the prosecutor's office. But don't keep visiting me. The visit was granted a month after Dong Ik's arrest. The family rushed to the detention center. The family was surprised to see Dong Yik for the first time in a long time. Dong Yik was too thin. Dong-ik told his family. He said he had never killed a woman, raped her, or committed a robbery. He confessed and even tested the scene, but in front of his family, he was resentful that he was not the culprit.

이 모든 비극은, 집에 형사들이 찾아온 바로 그날 시작됐어.
▲ 고문으로 인한 거짓 자백, 그리고 무기징역
형사들이 집에 찾아온 1991년 11월 8일 저녁. 잠깐 얘기 좀 하자는 형사들의 말에 동익 씨는 경찰차에 탔는데, 뒷좌석에 친구 인철 씨가 있더래. 무슨 일인지 몰라 인철 씨한테 말을 걸었더니, 다짜고짜 형사가 머리를 때려. 그렇게 영문도 모른 채 경찰서에 끌려왔는데, 분위기가 이상하게 흘러갔어.
유치장에 갇힌 채 나흘이 지났어. 형사가 나오라고 해서 갔더니, 눈에 테이프를 붙이고 어딘가로 끌고 가. 잠시 후 낯선 방에 도착했는데, 형사들이 동익 씨한테 낙동강에서 여자를 죽이고 강도짓을 하지 않았냐고 추궁해. 동익 씨는 범행을 강하게 부인했어. 그러자 형사들이 손목에 갑자기 수갑을 탁 채워. 그리고 거꾸로 매달아 놓는 일명 '통닭구이 자세' 고문이 시작됐어. 잠시만 매달려 있어도 엄청 고통스러워.

근데 이게 끝이 아니야. 수건으로 얼굴을 덮더니 물고문이 시작됐어. 형사들은 동익 씨를 고문하며 "자백하려면 손가락만 까딱까딱 해라"고 말했어. 그래도 동익 씨는 이 끔찍한 고문을 이틀이나 참으며 계속 범행을 부인했어.
경찰은 친구 인철 씨를 불러왔어. 동익 씨와 인철 씨는 경찰서에 끌려온 지 5일 만에 만났어. 형사가 인철 씨에게 "낙동강변에서 장동익이랑 여자 때려죽였지?"라고 물었어. 그러자 인철 씨는 "네"라고 대답했어. 동익 씨는 순간 귀를 의심했어. 인철 씨도 고문을 당해왔던 거야. 동익 씨보다 오랜 기간 동안. 심지어 겨자 푼 물을 코에 들이 붓기도 했대. 너무 힘들고 고통스러우니까 결국 거짓 자백을 한 거야. 그렇게 두 사람은 경찰 조사를 끝내고 검찰에 송치됐어.

검찰은 경찰과 다를 거라는 생각으로, 두 사람은 경찰 고문 때문에 허위로 자백했다며 범행을 전면 부인했어. 하지만 검찰은 혐의 그대로 재판에 넘겼어. 경찰 조사에서 아무런 문제가 없다고 판단한 거야. 목격자 진술, 증거, 자백까지 했는데, 이제 와서 왜 진술을 번복하냐면서.
이제 할 수 있는 건, 재판에서 고문당한 사실을 입증하는 거뿐이야. 두 사람은 자신들이 고문당한 걸 아는 증인을 찾았어. 다행히 함께 유치장에 있었던 사람들이 나서 증언을 해줬어.
"장동익은 한번 나가면 보통 자정이 되어야 돌아왔으며 새벽에 들어오는 것도 보았습니다"
"통증 때문에 잠을 못 이루는 것 같았으며 다른 피의자들도 보았습니다"
"발목은 까져서 피멍이 들어 있었으며 얼굴은 수건을 덮은 채 물을 붓는다고 했습니다"
- 고문 입증 증언들
하지만 1심 재판 결과, 두 사람에게 무기징역이 선고됐어. 고문을 받았다는 게 인정되지 않은 거야. 고문당한 걸 증언해 준 증인들의 말을 보면 '~라고 했습니다'라며 직접 본 게 아니라 들은 내용을 말하고 있다는 거야. 게다가 그 증인도 결국 유치장에 있던 범죄자 신분이니, 증언에 신빙성이 없다고 판단한 거지.
동익 씨 어머니는 1심 결과를 듣고 눈물을 펑펑 쏟았어. 그래도 가족들은 동익 씨가 죄가 없다고 굳게 믿었고, '항소심'을 준비했어. 가족들은 부산에서 이름 꽤나 날리던 인권변호사를 한 명 추천받았어. 바로 문재인 전 대통령이야.

당시 문재인 변호사의 전략은 두 가지였어. 첫째 '고문받았다는 증거를 더 보강한다', 둘째 '동익 씨의 안 좋은 시력을 무죄 입증에 적극 활용한다'는 것이야.

"(어머니의) 손가락 중에 제일 아픈 손가락. (형은) 걸어 다녀도 앞이 안 보이는 거를 그냥 감각으로 가는 거죠. 그냥 느낌으로 아는 거예요. 지리를 머릿속에 기억을 해놔요."

동익 씨는 시력이 너무 안 좋아서 초등학교 5학년 때 중퇴를 할 정도였어. 어머니는 아들의 눈을 고치겠다고 안 해본 게 없어. 자신의 눈이라도 넣어주려고 큰 병원에 갔는데 이식이 불가능하단 말을 들었어. 시력 교정도 아예 불가능하대. 눈에 문제가 있는 게 아니라, 시신경 자체가 위축된 불치병이라서. 이 이야기를 들은 문재인 변호사는 동익 씨의 시력을 정확히 검사해 봤어. 그랬더니 오른쪽 눈이 0.04, 왼쪽이 0.02 가 나왔어. 0.02 이하면 1급 시각장애 판정을 받을 정도야. 심지어 시야도 좁게 보여. 그런 동익 씨가 깜깜한 밤에, 사람을 납치하고 폭행해서 죽였다? 문 변호사는 무죄 입증에 자신 있었어.
동익 씨와 인철 씨 가족들도 2심에 대한 기대가 컸어. 하지만 재판 결과는 이번에도 '무기징역'이 나왔어. 동익 씨의 시력이 나쁜 거 알겠는데, 그건 현재 시력이 그렇다는 거고 사건이 일어난 2년 전에는 좋았을 수도 있다는 거야. 그런 판단의 근거는 동익 씨의 직장동료가 한 증언이었어.
동익 씨는 신발공장에서 일했어. 신발의 바느질 상태나 풀칠 상태를 검사하는 '검사과' 소속이었는데, 그곳에서 일하려면 "어느 정도의 시력은 있어야 한다"는 직장동료의 증언이 있었어. 이에 재판부는 신발공장 검사과에서 일했다면, 시력이 좋다고 판단한 거야.
그럼 2년 전에는 정말 시력이 좋았을까? 동익 씨가 신발 검사과에서 일한 건 맞아. 그런데 실수가 잦아서 쫓겨날 위기였대. 시력이 진짜 안 좋았으니까. 그럼 왜 이런 직장동료의 증언이 나왔을까? 사실 증인은, 총무과 직원이었어. 평소에 동익 씨가 일하는 걸 본 적도 없는 사람이야.
재판부는 두 사람이 고문받은 사실도 여전히 인정하지 않았어. 인철 씨가 고문 도중에 어금니가 부러지고, 팔에 박은 철심이 휘어졌다고 주장했는데, 재판부의 판단은 '고문으로는 그런 부상을 입을 수 없다'였어. 고문 후유증이 아니라고 판단한 거야.
동익 씨와 인철 씨는 지푸라기라도 잡는 심정으로 대법원에 상고했지만, 결과는 바뀌지 않았어. 그렇게 두 사람의 무기징역 형량이 확정됐어.

아들의 무기징역 확정 후, 동익 씨 어머니는 매 끼니마다 밥 한 공기를 더 퍼서 아랫목에 두기 시작했어. 나쁜 생각하지 말고, 빨리 나와서 함께 했으면 하는 마음으로… 어머니의 염원이 담긴 밥 한 공기였어.

"어머님 생각은, '밥 굶지 마라. 든든하게 먹어라. 살아 있어라' 그런 거예요. 형이 안에서 다른 생각 하지 않을까 싶어서… (가족들이) 바깥 생활을 견디는 것만큼 (교도소) 안에서도 견디면 좋은데, 다른 생각 하지 않을까. 기도 아닌 기도도 하고 그런 식이죠."

재판은 끝났지만 어머니는 포기하지 않았어. 재심이란 게 있잖아. 여기저기 언론사도 찾아가고, 청와대에 탄원서도 넣었어. 하지만 그 누구도 관심이 없었어. 그래도 어머니는 용기를 잃지 않고, "이거 한 번만 봐달라"며 사람들을 만날 때마다 봐달라 사정했어. 어머니가 내민 건 분홍 보따리였어. 그 안에는 아들 동익 씨의 수사 자료가 가득 들어 있었어.

"(어머니는) '근거를 남겨놔야 한다', '사건이 끝나면 저 변호사는 다른 일을 맡을 거고, 저 변호사가 그 사건 기록을 가지고 있을 거라는 보장도 없다', '기록은 가지고 있어야 한다. 네 학교가 중요한 게 아니다', '서류 챙겨라' 그렇게 말씀하셨어요. 그때 부산 서면에 복사하는 데가 많았어요. 양이 많을 땐 4~8시간, 짧으면 2~3시간씩. 복사본 뜨는 게, 학교 수업보다 중요했죠 나한테는."

이런 수사자료를 모은다는 건, 어려운 일이야. 어머니는 변호사들한테 부탁하고 또 부탁해서, 자료를 한 장 한 장 다 복사해서 남겨뒀어. 가족들이 전부 동익 씨를 위한 구명활동에 나섰어. 이런 와중에 어머니는 왕복 7~8시간 걸리는 아들이 있는 진주교도소를 1~2주에 한 번씩 꼬박꼬박 가셨어. 교도소 면회시간은 고작 10분 정도야. 그런데도 아들을 보려고, 그 먼 길을 가신 거야. 그리고 어머니는 동익 씨만 보러 가신 게 아니야. 다른 교도소에 있는, 친구 인철 씨의 면회도 가셨어. 따지고 보면 인철 씨의 허위자백 때문에 누명을 쓴 건데, 어머니는 인철 씨한테 서운한 기색 한 번 보이지 않으셨어. 늘 힘내라고 다독이면서, 친아들처럼 대해주셨어.
겉으론 강인해 보이는 어머니였지만, 속은 썩어 문드러진 상태였어. 밖에서는 희망을 잃지 않고 아들의 구명을 위해 발 벗고 뛰었지만, 집에 돌아온 어머니는 아랫목에 가만히 누워 일어나지 않으셨대.
시간은 흐르고, 교도소 생활에 점차 적응해 가. 동익 씨가 체포됐을 때 두 살이었던 귀여운 딸은 어느새 열 살이 됐어. 그 무렵 딸은 아빠가 교도소에 간 지 모르고, 먼 타지에서 일하고 있는 줄 알았어.
"아버지께. 아버지 그동안 안녕하셨어요? 저는 할아버지, 할머니, 학교 선생님 말씀도 잘 듣고 있습니다. 어디 아픈 데도 없으니 걱정하실 필요 없어요. 아빠, 일기는 매일 빠지지 않고 계속 쓰고 있어요. 생일은 4월 29일이에요. 그런데 막냇삼촌께서 강아지 인형 대신 햄스터를 사주셨어요. 밥 잘 먹고 공부도 잘 할게요. 아빠, 몸 건강하시고 안녕히 계셔요. 아빠! 힘내세요. 우리 아빠 사장님, 우리 아빠 좀 잘 봐주세요."
-당시 딸이 동익 씨한테 보낸 편지
딸은 무럭무럭 자랐고, 어느덧 동익 씨가 감옥에 들어온 지 10년이 지났어. 2003년 8월, 교도관이 동익 씨를 갑자기 불러내 축하한다고 전했어. 동익 씨가 모범수로 감형을 받은 거야. 무기징역이 아니라, 징역 20년이야. 앞으로 10년만 더 살면 출소할 수 있어. 억울한 옥살이를 하고 있으니 이 소식이 반갑지만은 않았을 동익 씨. 그래도 이 소식을 가족들, 특히 어머니가 아신다면 좋아하실 거야. 동익 씨는 이 소식을 바로 알리지 않았어. 곧 있으면, '가족 합동 접견'이 있거든. 2급 이상 모범수를 기준으로, 유리로 막혀있는 접견실이 아닌, 야외에서 가족들이랑 얼굴을 맞대고 접견할 수 있는 특별 면회야. 동익 씨는 그날 가족들에게 감형받았다는 소식을 알리려고, 그날만을 설레며 기다렸어. 그런데, 어머니가 합동접견에 못 오신다는 연락을 받았어.
"본인 아픈 것도 내색을 안 한 거죠. 우리도 그것을 몰랐고. 참 미안하고 죄송하고.."

사실 어머니는 암투병 중이셨어. 그동안 고통스러운 항암치료를 견디고 또 견디셨대. 아들의 억울함을 풀어줄 때까지, 어떻게든 버티려 하셨는데… 결국, 돌아가시고 말았어.

"눈 하나 감지 못하고 그대로 바짝 뜨고, 이를 악물고 눈을 바짝 뜨고 돌아가시더라고.."

얼마나 억울하셨으면, 눈도 못 감으셨을까. 가장 가슴 아픈 건, 어머니가 동익 씨의 감형 소식을 못 들으시고 돌아가신 거야. 그리고 동익 씨도 어머니가 돌아가셨다는 걸, 장례식이 끝난 뒤에 알게 됐어. 동익 씨는 어떤 마음이었을까.
▲ 21년 만의 출소, 재심을 위한 움직임
다시 10년이 흘러 2013년 4월 26일 밤, 진주교도소 앞. 동익 씨가 교도소 밖으로 나왔어. 21년 6개월여 만에 출소하는 날이야. 33살에 교도소에 들어간 청년이 55살, 중년이 돼서 밖으로 나왔어. 동익 씨를 직접 만나 이야기를 들어봤어.

"밤 열두 시에 내보내 주거든요. 나와서 배가 고프더라고요. 라면이라도 한 그릇씩 먹자 그래서 먹는데, 내가 밖에 있을 때 라면 한 그릇에 300원 받았는데, 무슨 라면 한 그릇에 3000원이나 받아. 무슨 칼 안 든 강도냐 했죠. 기분이 좋겠지만 마음의 짐은 더 무겁죠. (교도소) 안에 있을 때는 내 한 몸 건강 유지하며 살면 된다 생각하지만 밖에 나오면 풀어야 할 숙제가 많으니까 힘들더라고요."

20년 넘게 사회와 격리된 채 살았으니 적응이 쉽지 않겠지. 특히 동익 씨가 가장 대하기 어려워 한 사람은 딸이야. 너무 보고 싶던 딸과 21년 만에 드디어 같이 살게 됐는데, 말 한 번 섞기가 힘들더래.

"어린 시절에 과자 하나 사준 게 없어요. 공부할 때 노트, 학용품 하나 사준 게 없어요. 아무 추억이라는 게 없어요. 돌 지나고 그때 보듬고 있었던 게 다니까. 그것만 생각하는 거지. 아빠 없이 살았다는 것만 생각하지. 그러다 보니 미안한 게 많죠."

딸이 "사람들이 아빠에 대해 물어보면 뭐라고 말해?"라고 물었어. 동익 씨는 "사업하다가 잘못돼서 그래 된 거라 하자"고 둘러댔어. 딸과 대화를 마치고 방에 들어온 동익 씨는 가슴 한 구석이 너무 아팠대.
그때, 동익 씨 셋째 동생 봉익 씨가 분홍 보따리를 들고 와 형에게 보여줬어. 어머니께서 생전에 열심히 모은 수사 자료들이야. 그걸 본 동익 씨는 마음을 굳혔어. 재심을 받아 자신의 억울함을 풀고 가족들 앞에, 그리고 딸 앞에 당당한 아빠가 되자고 결심한 거야.
이후 동익 씨가 가장 먼저 찾아간 사람은 인철 씨야. 인철 씨도 감형받고 출소한 상태였어.

"동익이가 저를 찾으려고 집안 매제가 하는 그 가게에 왔더라고요. 이렇게 만났으니까, 우리 일을 하자, 누명을 벗어야 될 거 아니냐, 본격적으로 싸워보자. 이런 식으로 이야기하는 거죠."

두 사람은 오랜만에 의기투합했어. 분홍 보따리를 들고, 변호사 사무실, 법률구조공단, 인권위원회 등 여기저기 재심을 위해 찾아다녔어. 하지만 그때마다 돌아온 답은 "대법까지 확정된 사건을 뒤집긴 어려울 거 같습니다"였어. 두 사람을 믿어줄 사람을 만나는 게 쉽지 않았어.
그렇게 또 3년이 흘러 2016년 2월 서울역 앞. 분홍보따리를 손에 꼭 쥔, 동익 씨와 인철 씨가 누군가를 만나러 서울에 왔어. 이들이 만나려 한 사람은 문상현 기자였어.

문 기자는 신문사에서 일하는 1년 차 새내기 기자야. 두 사람을 만나 메모도 하고 얘기를 열심히 듣던 문 기자는, 중간중간 갸우뚱 거리기도 하고 가끔 의심의 눈초리로 쳐다봐. 그때 문 기자는 "그 분홍보따리요. 제가 한 번 빌려가도 될까요?"라고 물었어. 여태까지 아무도 관심 갖지 않던 보따리에, 문 기자가 관심을 보인 거야.
"가슴이 뛰기는 했었죠. 그렇다고 해서, 이걸로 '특종이다' 이런 생각은 안 했어요. 모르는 거잖아요. 그런데 오랜 시간 만나서 대화할 수 있었던 건, 그분들이 가져온 분홍 보따리 때문이었어요. 경찰, 검찰, 재판에 나왔던 공판 자료, 판결문, 심지어 그 안에 들춰보니 사진까지 다 있었어요."

문 기자는 이 자료들을 밤새 검토했어. 그리고 뭔가 기자로서 촉을 느꼈어. 고민 끝에 문 기자는 '재심' 하면 가장 먼저 떠오르는 사람, 재심 전문 박준영 변호사에 연락을 했어. 당시 박 변호사는 다른 재심 사건들을 한창 진행 중이었는데, 문 기자의 연락으로 만남이 성사된 거야.

근데 박준영 변호사가 너무 바빠서, 제대로 대화조차 나누지 못했어. 그래서 문 기자는 분홍 보따리만 겨우 건네주고 돌아왔어. 그리고 다음날, 문 기자의 휴대폰이 울려. 박 변호사였어.
"자료들 봤는데.. 이 분들 범인 아니에요. 같이 한 번 만나죠?"

▲ 속속 드러나는 거짓 증거들
박 변호사는 기록 일부와 판결문만 살펴봤는데, 이 사건은 무조건 해야겠다고 생각했대. 분홍 보따리 속 기본조차 갖추지 못했던 수사 자료를 보고, 깜짝 놀랐다는 거야. 이상한 게 한두 가지가 아니었대.

먼저, 살인 사건의 목격자이자 동승자였던 김영준 씨의 진술 조서에는 '1990년 1월 북부경찰서'라고 적혀있어. 살인사건이 막 터졌을 당시에 진술조서인데, '90년 1월'까지만 쓰여있고, 며칟날 작성된 건지 적혀있지 않아.

그리고, 두 사람이 처음 체포된 혐의는 '경찰 사칭' 혐의야. 그 혐의 관련 범행 일람표인데, 자세히 보면 피해자, 피해차량이 '일체불상, 번호불상'으로 명시돼 있어. 단 1건을 제외하고는, 피해 차량을 모른다는 거야. 피해자가 없는, 사건이 조작됐을 가능성이 있다는 거야.
재심을 위해선 명확한 증거들이 더 필요해. 박준영 변호사는 SBS '그것이 알고 싶다' 팀과 함께 이 사건의 단서를 하나하나 찾기 시작해. 최인철 씨를 범인이라 지목한 결정적 증거 손수건. 거기서 검출된 혈액형은 인철 씨와 같은 AB형이었어. 근데 '국과수 감정 의뢰회보'를 보면 이야기가 또 달라져.

"A형과 B형, A형과 AB형, B형과 AB형이 혼합된 경우에도 AB형으로 반응할 수 있음."
A형 혈흔과 B형 혈흔이 섞여도 AB형이 나올 수 있다는 거야. 그런데 경찰들은 이 중요한 정보를 누락시키고, 자신들 마음대로 취사선택 해서 인철 씨를 범인으로 지목한 거야.
더 황당한 건, 처음에 두 사람이 피해자를 '각목'과 '주먹만 한 돌'로 해쳤다고 경찰이 발표했잖아? 그런데 애초에 이건 범행도구가 될 수 없어.

"(각목으로) 두 군데 2회를 때렸다는데 각목으로 맞으면 두피와 흉기 사이에서 두피가 찢어져요. 쉽게 찢어지는 부위예요. 그런데 오른쪽 이마에는 개방성 손상 외에는 다른 것에 찢어진 상처가 없다는 거…"
"두 손으로 (커다란 돌을) 겨우 들어서 내려찍을 정도. 그 정도의 무게와 면적이 있어 줘야 함몰과 아울러서 분쇄골절이 같이 동반될 수 있어요."

애초에 각목은 사용하지 않았고, 주먹만 한 돌로는 분쇄골절이 불가능하다는 법의학적 분석이야. 범행도구를 전부 조작한 거야. 그것도 아주 허술하게.

그리고 마지막 한 가지. 인철 씨와 동익 씨는 진술 당시, 사망한 피해자를 들어서 옮겼다고 진술했어. 근데 피해자 박 씨의 등에 난 상처를 보면, 쓸린 상처들이 가득해. 시신을 끌고 갔다는 이야기지. 이건 범인이 두 명이 아니라, 한 명일 수도 있다는 거야.
▲ 30년 만에 얻어낸 '무죄' 판결
박준영 변호사는 2017년 5월, 재심 신청을 했어. 근데 2년이 넘게 감감무소식이야. 검찰과거사위원회(검찰의 과거 인권침해 및 검찰권 남용 의혹이 제기된 사건을 선정한 뒤 진상 규명을 하는 위원회)에서 이 낙동강변 살인사건을 조사하고 있었던 거야. 정말 고문이 있었는지, 수사 과정에 문제가 없었는지, 강도 높은 조사를 했는데, 시간이 너무 오래 걸렸던 거지. 검찰 과거사위에서 이 사건을 조사한 건, 박준영 변호사의 신청 때문이었어.
"내가 이걸 괜히 신청했구나. 내가 여기를 들어오지 않았어야 되는데. 저는 좀 빨리, 그리고 확실하게 해결하려고, 기존 조사 내용을 잘 살펴서 확인해 달라는 의미로 청구를 했는데. 오히려 더 엄격하고, 중립적이고, 그러려고 하더라고요. 그래서 답답하기도 하고 힘들기도 했어요."

박 변호사는 재심 때 도움이 될까 싶어 과거사위에 신청한 건데, 생각보다 조사 기간이 너무 길어졌던 거야. 그런 기다림에 속이 타들어가는 건 동익 씨와 인철 씨지. 그리고 오랜 기다림 끝에, 검찰은 이런 발표를 해.
"이 사건은 고문으로 인해 범인이 조작된 사건으로 보입니다."
검찰이 수사를 통해 당시 경찰의 고문행위를 인정한 거야. 놀랍게도, 두 사람이 검거되기 두 달 전에 같은 경찰서에서, 물고문을 받고 허위자백을 했다가 재판 도중에 풀려난 사람이 있었대. 그 피해자의 진술이, 동익 씨와 인철 씨가 당한 것과 일치했어.
"사하경찰서 안인데 별채 별관이었습니다. 강도짓을 했다고 손목에 수갑을 채운 상태에서 다리 뒤쪽으로 쇠파이프를 끼워 가지고 거꾸로 매달았습니다. 물고문을 했는데 물을 안 마시려고 푸푸 하다가 끝이 나지 않으니까 물을 마셔버렸습니다. 고문할 때 '자백하거나 할 말 있으면 손만 까딱거려라' 했습니다."

그다음 해에 드디어 재심개시결정이 내려졌어. 재심 신청 3년 만이야. 이제야 유무죄 여부를 가릴 수 있게 된 거야. 아직 무죄 판결이 난 것도 아닌데, 이날 동익 씨와 인철 씨는 그동안의 서러움을 쏟아내듯 펑펑 우셨대.

So what was the outcome of the retrial? On February 2021, 2, the Busan High Court ruled "not guilty" in a retrial. It's 4, 30 years after the incident. I was finally acquitted.

"I had been waiting patiently for a day like this when I had endured all these years. It's heart-wrenching, it's heartbreaking, and yes."

who never apologized
Then, what kind of responsibility did the people in
charge of the investigation bear at that time? From the police who tortured the two men, to the prosecutor in charge who didn't look into the case properly, did Dong Ik and In-cheol get an apology?

"They're never like that. Do you beat them, squeeze them, and torture them? Make? At that time, it was also after the death of Park Jong-ch'ol, so it wasn't even a time when you could do torture or anything like that, actually."

One detective denied that there had been any torture. When I went to another detective and asked if Dong Yik and In-cheol were the real culprits, he suddenly tore up the tape, put it in his mouth, and fell silent.
This time, I went to the prosecutor in charge of the case. When Dong Yik and In-cheol greeted each other, the prosecutor said in a hushed voice, "I don't have anything to talk about with you! Go out! Just kidding me now. Don't you get out? Get out!" I said, rather, squirmed.

At the time, it was the police, the prosecutor's office, they all denied it. I've never apologized. I was caught for not knowing, or I was rather angry. They were not punished because the statute of limitations had passed.
After being exonerated, Dong Ik and In-cheol applied for criminal compensation for their wrongful imprisonment and also sued the state for damages. Luckily, this was fully compensated. But the great thing about these people is that they are preparing to establish a scholarship foundation with this reward. Lawyer Park Joon-young is also involved in the foundation's work.

Dong-ik and In-cheol visited Haeundae Beach, where they took a photo together 30 years ago. Dong-ik feels most comfortable getting into In-cheol's car. In-cheol walks away, holding Dong-ik's hand, who can't see well. They're still good friends.

"That was 30 years ago, and I can't help but think about that time. When my mom and dad were sixtieth birthday, I moved to Busan and I hadn't been to Haeundae, but they said let's go to Haeundae once, so I remember coming with my friends."
