A court has sentenced a teacher who sexually assaulted a student who had nowhere to go after being abused by his family to the residence to protect him.

Yesterday (22nd), the 12th Criminal Division of the Gwangju District Law (Chief Judge Kim Hye-sun) sentenced Teacher A, who was accused of violating the Special Law on the Punishment of Child Abuse Crimes (aggravated punishment of child abuse by child welfare facility workers, etc.), to three years in prison and ordered her to restrict her from working in institutions related to children, adolescents, and the disabled for three years.

Miss A, who was a teacher at a school in Gwangju, was put on trial for molesting or sexually assaulting Miss B, a student, more than 3 times in the residence between late November 3 and early January last year.

In 2021, Miss A helped her disciple by reporting it to the police after hearing from Miss B that she had been "abused by her mother."

Miss B could no longer live with her mother, and Miss A offered Miss B the role of guardian by asking her to "stay together."

In response to Miss A's favor, Miss B trusted and relied on him, telling her about her past sexual abuse, but Miss A then began to commit the offence several times, telling Miss B, "I would rather be safe at home than have a dangerous sexual experience outside."

Despite Miss A's unusual demands and Miss B's refusal to do so, the crime continued, and Miss A's crime intensified as the winter vacation began.

Miss B, who had been enduring this by complaining to a friend who attended another school through social media, finally informed the school and was able to escape from Miss A.

When the school learned of Miss B's damage, they reported it to the police and dismissed Miss A.

Appearing in court, Miss A denied the offence, claiming that she had "not had any sexual contact with Miss B and that her illness made it impossible for her to commit the offence."

However, the tribunal did not accept Miss A's argument, saying that "Miss A's statements in important areas such as illness are inconsistent, while Miss B's statements are consistent and detailed."

The court explained the reasons for the sentencing, saying, "Miss A made no effort to recover the damage, even though she is a student at her school and a de facto guardian, is guilty of sexually abusing Miss B, and Miss B has no special motive to exonerate Miss A."
