While Alec Baldwin and Hannah Gutierrez-Reed were both charged with manslaughter last month, the case is not yet ready for trial. The actor is being prosecuted as part of the investigation into the death of Halyna Hutchins, who died when the actor discharged his gun on the set of Rust. The charges against him have just been lightened but this is not the only point that justice must address before going to court.



Indeed, as relayed by the New York Times, the actor's lawyers have submitted another opposition in order to avoid a trial for their client. In particular, they questioned the "constitutionality of the choice of the district prosecutor to appoint special prosecutor Andrea Reeb" in this case, being also an elected representative of the state, which would make her appointment "illegal". A judge must rule on this request, which could affect the rest of the case. Regarding the indictment, a first hearing has already been stopped.

Maintenance of innocence

The two accused will indeed appear this Friday. Alec Baldwin, for his part, still assures that he did not pull the trigger of the weapon. However, an FBI report concluded that the weapon could not have discharged on its own.

Filming of Rust, meanwhile, will be able to resume, Alec Baldwin and the other producers having reached an arrangement with the widower of Halyna Hutchins last October. Matthew Hutchins became executive producer of the western.
