A bakery in Binhu District, Wuxi City, made an 12-inch birthday cake based on pictures sent by customers, with six cartoon dolls. A Shenzhen animation company claimed that the cartoon dolls used in the cakes infringed the copyright of its "Bear Haunted" series of art works.
The court held that although the defendant bakery provided Taobao orders, it could only prove the objective source of the doll's ornament, not the legal source. The bakery stopped the infringement and was willing to pay compensation to the animation company to settle the dispute.
